Prop 65

The Safe Drinking Water and Toxic Enforcement Act of 1986 requires businesses to warn consumers about exposure to chemicals known to cause cancer, birth defects, or other reproductive harm. Businesses may be liable for civil penalties of up to $2,500 per violation, per day, retroactive for up to one year. Even a single overlooked chemical in a product or on a website can result in hundreds of thousands of dollars in liability.

How We Protect Consumers

  • Akempis works with laboratories and expert toxicologists to investigate violations.
  • Akempis sends 60-Day Notices of Violation to put companies on notice.
  • Akempis negotiates settlements, including reformation, warning requirements, and monetary settlements, where possible.
  • Akempis files civil complaints with the courts where needed.
